Terms and Conditions of Sale (T&C)

These Terms and Conditions of Sale apply to all purchases made on the website Clare Jones Paris, operated by Clare Jones, a French sole trader under the author-artist status.

By placing an order on this website, the customer fully accepts, without reserve, the present conditions of sale. The general conditions of sale shall prevail over any other general or particular conditions not expressly approved by CLARE JONES PARIS.

CLARE JONES PARIS reserves the right to modify its general conditions of sale at any time. In this case the applicable conditions will be those in force at the date of the order by the buyer.

The products offered for sale are original artworks and creative products designed by Clare Jones, including:

Printed illustrations (art prints)

Digital illustrations (downloadable files)

Greeting cards

Postcards

Bookmarks

Concertina books

Recipe books

Decorations

Each product has a description. The photographs provided are as accurate as possible but cannot ensure a perfcet similarity with the product offered. Light variations in colour or appearance may occur depending on screen settings or printing processes.

3. Prices

The prices are displayed in Euros (€) unless otherwise stated. CLARE JONES PARIS reerves the right to adjust prices at any time; however, products will be invoiced based on the prices in effect at the time the order is confirmed. The prices indicated include only order processing costs, but do not include shipping and delivery costs.

4. Geographic area

We deliver to mainland France and Corsica, the European Union, the United Kingdom, Switzerland, Canada, the USA and Australia. For orders shipped outside of the European Union custom duties, local taxes, or import fees may apply and are the sole responsibility of the customer.

5. Orders

Orders are placed via the Clare Jones Paris website. The buyer must fill in the registration form on which he will indicate all the requested details, validate his order after having checked it, make the payment in the condition provided and confim his order and payment. The confirmation of the order implies acceptance of the conditions of sale and recognition of having perfect knowledge of the conditions. All the data provided and the recorded confirmation is worth proof of the transaction. The confirmation will be worth the signature and acceptance of the operations carried out.

The seller will send by e-mail confirmation of the registered order once the payment has been successfully processed.

The seller reserves the right to refuse or cancel any order in the event of a dispute with the customer.

6. Payment

Payment is due immediately upon ordering. Payments will be made by credit card and apple pay. All payments are processed securely through the protective mode of payment SSL (Secure Socket Layer) so the information transmitted in encrypted by software and cannot be accessed by any third party when on the  network. The buyer’s bank account will be debited after the validation of the order.  An invoice including VAT is available at any time in the buyer’s account, or upon request.

7. Right of Withdrawal

Physical Products

In accordance with European consumer law, customers located in the European Union have a 14-day right of withdrawal from the date of the delivery of the goods, without having to justify their decision. Return shipping costs are borne by the customer. Returned items must be in perfect condition and sent back in their original packaging. All returns are to be sent back to : Clare Jones Paris, 2 rue du bois de Boulogne, 92210 Saint-Cloud, France.

Digital Products

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately after purchase once the customer has expressly agreed to waive this right.

8. Delivery – Physical Products

Physical products are shipped to the delivery address provided by the customer at checkout. The risks are the responsibility of the buyer from the moment the products have left the premises of CLARE JONES PARIS. In case of damage during shipment, you must send an official claim to the carrier within three days of delivery.

Delivery times are given as an indication only and may vary depending on the destination country.

The seller cannot be held responsible for delays caused by postal services or customs authorities.

9. Delivery – Digital Products

Digital products are supplied as downloadable files. Upon payment confirmation, the customer receives access to the download. No physical shipment is involved.

10. Guarantee

All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following the Civil Code. In case of non-conformity of a product sold, it can be returned to the seller who will take it back, exchange it or, refund it. All claims, requests for exchange or refund must be made by mail to the following address within thirty days of delivery: CLARE JONES PARIS, 2 rue du bois de Boulogne, 92210 Saint-Cloud, France.

11. Intellectual Property and Usage Rights

All elements of the CLARE JONES PARIS website are and remain the exclusive interlectual proiperty of CLARE JONES PARIS. All artworks remain protected by copyright. The purchase of a physical or digital product does not transfer any intellectual property rights. Unless otherwise stated, products are intended for personal, non-commercial use only. Any reproduction, distribution, modification, or commercial exploitation without prior written consent from Clare Jones is strictly prohibited.

12. Liability

Clare Jones Paris shall not be held liable for indirect damages resulting from the purchase or use of the products. The seller, in the process of selling online, is only bound by an obligation of means; his responsibility cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems.

13. Personal Data and archives

Personal data is processed in accordance with the French Data-Processing & Freedoms law of January 6, 1978. Further details are available in the Privacy Policy. CLARE JONES PARIS will store a copy of the invoices on a reliable and durable support system in accordance with the provisions of article 1348 of the Civil Code. The computerised registers of CLARE JONES PARIS will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by French law, regardless of the customer’s country of residence. In the event of a dispute, an amicable solution will be sought prior to any legal action. Failing this, the French courts shall have exclusive jurisdiction.
